Mother of child who died on Klamath County expedition sues Boy Scouts for $10 million

CORVALLIS, Ore. — Last fall, a teenage boy died on a Boy Scout expedition near Middle Rosary Lake in Klamath County. Now the boy's mother is suing the Boy Scouts of America (BSA), alleging that the adult volunteers were unprepared and left the boys unsupervised.

16-year-old Nolan Henderson went on the camping trip in October of 2018 with a Boy Scout troop out of Corvallis, his home town. During a hike, two of the boys fell from a peak near the lake, the Klamath County Sheriff's Office reported at the time. Rescuers were able to recover one of the boys and bring him to the hospital, but Henderson was found dead at the scene.

Margaret Henderson, Nolan's mother, now says that none of the six adults volunteering with Troop 163 had proper medical, first aid, or wilderness training.

The lawsuit also claims that scout master Lucas Turpin went hiking with several of the boys while most of the group was setting up camp. Turpin then returned to camp — leaving the boys without any supervision, according to the suit.

Nolan was reportedly climbing down a steep rock face when he grabbed onto a rock that suddenly came loose, causing him to fall backward.

The lawsuit alleges that the troop leaders let Henderson go on an unreasonably dangerous hike, didn't supervise the hike, didn't provide proper aid to Nolan after he fell, and violated BSA policies.

Henderson's mother is asking for $1.5 million for the pain and suffering that Nolan endured, $500,000 for burial services, and $8 million for being deprived of her son's love and companionship.

Margaret is suing the Oregon Trail Council alongside Boy Scout Troop 163.
